User Agreement

This agreement pertains to any services provided by MassNFCA.org. Please read the rules contained in this agreement carefully. If you cannot agree to the terms and conditions in the User Agreement, do not use or access our website or services. These rules may be modified from time to time; the date of the most recent revisions will appear on this site. MassNFCA.org allows members to add information to the site through creating member profiles, posting comments, and listing requests for carpools.

By using MassNFCA.org, you signify you are agreeing to the terms below concluding a legally binding contract with MassNFCA, a non-profit corporation located in Boston, Massachusetts. If you do not agree, please do not use our site.

USE OF THIS SITE SIGNIFIES YOUR AGREEMENT TO THE USER AGREEMENT, PRIVACY POLICY, AND THE COPYRIGHT AND TRADEMARK NOTICE.

The following information explains the terms on which MassNFCA.org offers you access to our services:

1. Registration and Membership - The Service is not intended for users under the age of eighteen (18), and MassNFCA.org, does not knowingly collect personal information from users under the age of 18. Information submitted by such users will not knowingly be used, posted, or retained by MassNFCA.org. We reserve the right to refuse service, terminate accounts, and remove or edit content in our sole discretion. Our services may only be used by individuals who can form legally binding contracts under applicable law. MassNFCA.org is in no way responsible for any statements made through any of our registered user's profiles or other content added to the site by users.

2. Fees and Services - It is free to register on MassNFCA.org. Any changes to the policy will be posted on MassNFCA.org, and will take effect within seven (7) days after notice is given on the site.

3. MassNFCA.org is a Venue – MassNFCA.org is a venue. MassNFCA.org, has no control over any listing or information that might be shared on the site. We also have no control over the truth or accuracy of the listings, services or any information that is advertised and/or provided by its users. If you have a dispute with one or more users, you release Massachusetts Network of Foster Care Alumni, (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

4. Fraud in Connection with MassNFCA.org - MassNFCA.org, may suspend or terminate your account if we suspect that you have engaged in any form of fraudulent activity in connection with the use of the site. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead in any form. MassNFCA.org, reserves the right to remove or edit such content or terminate your account. MassNFCA.org, takes no responsibility and assumes no liability for any content posted by you or any third party. Registered users of MassNFCA.org are also prohibited from: (1) Providing false or misleading information about themselves (2) selling stolen or counterfeit goods, (3) using obscene media (photos, video, audio, etc.), (3) violating any laws in the United States or Internationally, (4) threatening or harassing other members; and (5) distributing any materials with any form of viruses, trojan horses, worms or any performance that will cause harm to other users.

5. Resolution of Disputes - You and Massachusetts Network of Foster Care Alumni agree that any claim or controversy at law or equity that arises out of this User Agreement, Privacy Policy or our services shall be resolved through arbitration. Arbitration is a form of Alternative Dispute Resolution (ADR) in which parties choose an impartial third party to hear and decide the dispute. This arbitration hearing will be held in Suffolk County, Massachusetts or another location mutually agreed upon by the parties.

6. Copyrights, Trademarks and Patents - All content included on MassNFCA.org, such as text (comments, reviews, updates to member profiles), graphics, logos, button icons, images (resource database), audio clips, data compilations, videos and software, is the property of MassNFCA or its content suppliers and are protected by United States and international copyright laws. Any violations or misuse will be met with monetary damages. Any copyrights associated with MassNFCA.org may not be used by anyone other than MassNFCA.org unless you have express written consent from Massachusetts Network of Foster Care Alumni.

Registered trademarks or patents - on MassNFCA.org may not be used by anyone other than MassNFCA.org unless you have express written consent from Massachusetts Network of Foster Care Alumni. All other trademarks patents not owned by MassNFCA.org or its subsidiaries that appear on our site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Massachusetts Network of Foster Care Alumni or its subsidiaries.

General

1. General - This Agreement shall be governed in all respects by the laws of the State of Massachusetts as such laws are applied to agreements entered into and to be performed entirely within Massachusetts between Massachusetts residents. These terms are the entire agreement between the parties. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.

Warranty - THE CONTENT, CODE, ACCESS, AND OTHER FEATURES OF THIS SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THIS SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE WE RESERVE THE RIGHT TO CORRECT ANY ERRORS OR OMISSIONS ON MASSNFCA.ORG, EVEN THOUGH WE TAKE MEASURES TO ENSURE THAT THERE ARE NO VIRUSES, WORMS, OR ANY OTHER FORM OF DESTRUCTIVE MATERIALS ON THIS SITE, WE DO NOT GUARANTEE THAT MASSNFCA.ORG, OR MATERIALS THAT MAY BE DOWNLOADED FROM MASSNFCA.ORG, DO NOT CONTAIN THESE MATERIALS. Privacy Policy

MassNFCA.org (also known as – Massachusetts Network of Foster Care Alumni) respects your right to privacy. We know that your personal information is important to you and it is important to us to keep it safe. When you enter personal information on MassNFCA.org, you can be positive that the information that is given will be kept confidential and protected. All of our information is also protected by an SSL (Secure Socket Layer).

The privacy policy below will explain the measures that we take in protecting your information. This policy does not apply to items beyond the control or ownership of MassNFCA.org (Massachusetts Network of Foster Care Alumni).

This privacy policy applies to our services under the domain name of MassNFCA.org. The information that we gather from customers helps us organize, personalize and improve the quality, ease of access and user friendliness of our site. Please note that any video, image, or other content posted at the direction of users onto MassNFCA.org becomes published content and is not considered personally identifiable information subject to this Privacy Notice.

1. Information We Collect - This privacy policy applies to all information collected or submitted to MassNFCA.org. The types of personal information collected includes but is not limited to: Name, Address, Email, User ID, Passwords, and Phone Number. Once you are a registered user you can update and delete your profile. Once a profile is deleted, all personal information shall be removed from the website with the exception of resource reviews which may remain on the site even if the member who posted the review has deleted their profile. Once a member has deleted a member profile, they may request in writing that MassNFCA.org remove all resource reviews.

2. How We Use Information - The main purpose in collecting personal information is to provide you with complete access and features that are available on MassNFCA.org. With the information that is provided by you, we can make your experience safe and easy. MassNFCA.org, will not share your personal information with third parties In the event of a criminal investigation or a suspected illegal activity, we may be requested by law enforcement agencies to share certain personal information. We may also give your information if we have a good faith belief that disclosure is necessary to (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect someone's safety. If by chance MassNFCA.org (Massachusetts Network of Foster Care Alumni), is acquired by another company, your personal information may be part of the assets transferred to the acquiring company.

3. How Secure is Your Information - We protect your information by using Secure Sockets Layer (SSL) software, which encrypts information you input. SSL encryption is a method by which information transmitted across the internet is encoded to defeat theft by anyone who should intercept the data. MassNFCA.org, utilizes the SSL when any sensitive material is being accessed or inputted. It is important for you to protect against unauthorized access to your password and to your computer.

4. Cookies - We use cookies to understand visitor traffic patterns to improve usability. Your computer provides this information automatically, but we do not save this data, except in summary form, after the end of your visit. MassNFCA.org may place "cookies" on your computer so our site can better help in matching your interests and preferences. Most browsers allow you to erase cookies or block them.

5. Car Pool Forum - MassNFCA.org allows its member to arrange and schedule carpools to MassNFCA events through a carpool forum. MassNFCA does not provide transportation services or in any way functions as a transportation carrier. The carpool forum is made available solely for MassNFCA user's personal, noncommercial use.

MassNFCA is not responsible for the conduct of any member arranging a carpool through the forum forum . You agree to indemnify and hold MassNFCA and its officers, directors, employees, and agents harmless for any and all claims , demands, losses, liabilities, and expenses (including attorney's fees) arising out of or connection with your use of the carpool services program on MassNFCA.org.

MassNFCA.org may be used to request and schedule transportation to MassNFCA events with other users but you agree MassNFCA.org has no responsibility or liability to you related to any transportation or logistics services provided to you other than as expressly set forth in these terms.

Aside from basic cost sharing for expenses directly associated with the provision of the carpool, members will not charge a fee for providing a carpool to another member.

6. Deactivation of Your Account - Upon written request (thru email or regular mail) or online cancellation we will deactivate your account. Any information that you added to MassNFCA.org, such as resource reviews will remain part of the site even after you account is deleted.

7. Children –Persons under the age of eighteen (18) are not eligible to use MassNFCA.org.Massachusetts Network of Foster Care Alumni, takes no responsibility in the actions of a minor in regards to the website.

8. Changes to the Existing Privacy Policy - MassNFCA.org, reserves the right to update or modify this privacy policy, at any time and without prior notice, by posting the revised version of this policy on the site. If we modify this privacy policy, the modifications will only apply to the personal information we collect after we have posted the revised policy or privacy statement on MassNFCA.org.

Social Media Policy

The Massachusetts Network of Foster Care Alumni (MASSNFCA) would like its presence on social media sites to be honest, open, and respectful. In an effort to be transparent about our social media policies, we share our social media guidelines here.

Together We Create an Open and Respectful Place of Exchange:

MASSNFCA encourages lively and discussion in its networking social media platforms, but will not tolerate comments which are off topic, abusive, obscene, defamatory, vulgar, threatening, or which invade privacy or are libelous, including as described below. Offenders will be banned from posting. We will also remove posts that include gross errors of fact. Any member may suggest removal of any comment which appears to violate this policy.

Comments are Subject to Public Disclosure

All comments submitted or posted on MASSNFCA's social media accounts are public. MASSNFCA reserves the right to restrict or remove any content that violates these policies or any applicable law.

Comments by Others are NOT Endorsed

MASSNFCA does not necessarily endorse, support, sanction, encourage, verify, or agree with the comments, opinions or statements posted on its social media accounts. Any information or material placed online, including advice and opinions, are the views and responsibility of those making the comments and do not necessarily represent the views of MASSNFCA. By submitting a comment for posting, you agree that MASSNFCA is not responsible, and shall have no liability to you, with respect to any information or materials posted, including defamatory, offensive, or illicit material, even material that violates this policy.

The Right to Report Threatening Comments

MASSNFCA must also reserve the right to report any comments that imply harm or imminent danger to yourself or others. By submitting a comment for posting, you accept that MASSNFCA has the right to contact the appropriate authorities to report any suspicious activities, threats or behaviors.

Editing and Deletions

MASSNFCA reserves the right, but undertakes no duty, to review, edit, move, or delete any material submitted as a comment to information provided for display or posted on its social media accounts in its sole discretion, without notice. Comments submitted to these sites will be reviewed and posted on the website if they meet our comment policy. Although MASSNFCA will monitor all websites on a regular basis for inappropriate or defamatory content, comments submitted after regular business hours, Monday through Friday, will be read and posted or deleted as early as possible.

Inappropriate comments will be deleted at the sole discretion of MASSNFCA. While we encourage submissions from all viewpoints, we ask that all participants adhere to the following Terms of Participation:

  • To ensure constructive networking please post only questions or comments directly related and relevant to MASSNFCA and the topics discussed.
  • Do not post questions that contain threats, obscenities, and any other material that would violate the law if published, such as abusive, defamatory, or sexually explicit material.
  • Submissions containing the following will be deleted:
  1. Obscene or threatening language or discrimination (hate speech) based on race, sex, gender, religion, national origin, age or disability
  2. Commercial services or products
  3. Any personal or sensitive information (phone numbers, e-mail, or postal addresses)
  4. Any endorsement of religious beliefs/practices or political parties, candidates, or groups
  5. Any posts or links intended to influence (lobby) a Member of Congress or government official on legislation or appropriation

In the event that your original post contains an appropriate resource, MASSNFCA may ask you to modify your posting by removing any portion that breaches this policy.

Appropriate URL Format

MASSNFCA reserves the right to remove any URLs that pose or appear to pose a security threat to its site, the United States Government and other users, including, but not limited to, any URLs that have been shortened by third-party sites (i.e. bit.ly, tiny.cc). Since MASSNFCA will actively check and monitor all links, users may only post content containing a full web address. The only exception to this rule are sites that limit characters, such as Twitter. Users are advised to click on third-party content at their own risk.

The posting of external hyperlinks does not constitute endorsement by MASSNFCA of the linked Web sites, or the information, products, or services contained there.
